The Lake Management and Aquatic Services industry is facing new regulatory challenges. As of April 9, 2011, National Pollutant Discharge Elimination System (NPDES) permits will be required for discharges to waters of the United States of biological pesticides and chemical pesticides. The United States Environmental Protection Agency (EPA) has issued a draft Pesticide General Permit (PGP) and intends to issue a final general permit by December 2011. This permit will apply to any applictor engaged in mosquito and other flying insect pest control, aquatic weed and algae control, aquatic nuisance animal control, and/or forest canopy pest control. Applicators that exceed a threshold amount of pesticides each year will have additional reporting requirements under the permit. These requirements include submitting a Notice of Intent (NOI), preparing a Pesticide Discharge Management Plan (PDMP), and submitting an annual report for all pesticide activities covered under the permit.
